The Customer will provide ayeforo.com with all reasonable assistance and facilities free of charge (including information, photos etc.) in order to permit ayeforo.com to efficiently provide the Services.

CREDIT FACILITIES

Services rendered by ayeforo.com are to be paid for before delivery. No credit facility shall be extended to any party.

ALTERATIONS

Changes to a published wedding website will be effected at a cost to the Customer, the cost of which will be determined at the time of service request. A website is deemed to have been published when one or more pages of it have been uploaded to web servers and can be viewed over the internet.

REFUNDS

There shall be no refunds made for services rendered by ayeforo.com. A service is deemed to have been rendered when a Customer’s website has been constructed on ayeforo.com’s computers, prior to uploading to our web servers.

INTELLECTUAL PROPERTY

Unless otherwise agreed in writing by ayeforo.com, the copyright and all other rights relating to any software provided to the Customer by or on behalf of ayeforo.com pursuant to this service (the "Intellectual Property") will remain the property of ayeforo.com or where applicable its licensors.

Upon payment in full for the Services provided by or on behalf of ayeforo.com pursuant to this service, ayeforo.com grants the Customer a non-exclusive and non-transferable perpetual license to use the Intellectual Property for the Customer's own purposes, and in the case of the third party software, will obtain a sub-license in favour of the Customer in similar terms.

Splash Technology Ltd warrants to the Customer that to the best of its knowledge, it has the right to grant the licenses referred to in these Terms, and the use by the Customer of any software provided by will not infringe the rights of any third party.

The Customer will not request for or be given copies of software (in source and/or in object code) and other materials produced as a result of ayeforo.com rendering service to the Customer.

LIABILITY

Except for express undertakings to indemnify and any warranties set out in these Terms:

To the extent permitted by the law, ayeforo.com expressly excludes all conditions and warranties whether express or implied.

Notwithstanding any other provision in these Terms, in no event will ayeforo.com be liable to any party including the Customer for any indirect, punitive, special, incidental or consequential damage in connection with or arising out of our services (including for loss of profits, use, data, or other economic advantage), however it arises, whether for breach of these Terms or in tort, and even if ayeforo.com has been previously advised of the possibility of such damage. Further, liability for such damages shall be excluded, even if inclusive remedies provided hereunder fail their essential purpose. The Customer will indemnify ayeforo.com and keep it indemnified from and against any claims by any third party for or in respect of such damages.

Certain provisions relating to the trading of goods and services and other statutes, rules and regulations may imply certain non-excludable warranties or conditions. To the extent that they are not permitted to be excluded, ayeforo.com’s liability for breach of such conditions or warranties and the Customer's sole and exclusive remedy in relation to such breaches shall be limited to:

• in the case of Products or software or other goods supplied by ayeforo.com, at ayeforo.com’s option: the replacement or repair of those Products or software or goods, or the supply of equivalent goods
• in the case of Services, at ayeforo.com’s option: supplying the Services again
